—In an action, inter alia, to recover damages for breach of a fiduciary duty, the defendant appeals, as limited by his brief, from so much of (1) an order of the Supreme Court, Dutchess County (Hillery, J.), dated December 14, 1995, as directed the plaintiff to post an undertaking in the sum of only $30,000 as a condition to the continuation of a preliminary injunction, and (2) an order of *313the same court, dated May 10, 1996, as denied that branch of his motion which was, in effect, for reargument.
