This is an appeal from a habeas corpus proceeding in the United States District Court for the Southern District of Texas, Houston Division. On May 13, 1970, the Petitioner (appellee), George Edward Gray, was found guilty by a jury in the 184th District Court of Harris County, Texas, of the offense of murder with malice and was sentenced by the court to seventy-five years confinement in the Texas Department of Corrections.
