Action on the case by appellee against appellant, for alleged negligence in causing the death of her intestate. The jury found the issue for plaintiff, assessing her damages at $5,000. A new trial was denied, judgment rendered on the verdict and this appeal taken.

Deceased shipped a car load of horses and household goods at Webster City, Iowa, for Lebanon, Indiana, via Dun-lei th, Freeport, La Salle and Wenona, Illinois, on a through freight train of appellant for Chicago, which left between seven and eight o’clock in the morning of April 15, 1894.
