Defendants-Appellants the City of New York, Bernard Kerik and Rudolph Giuliani (collectively “the City”) appeal from an opinion and order of the United States District Court for the Southern District of New York (Lawrence M. McKenna, Judge) entering a preliminary injunction in favor of Plaintiffs-Appellees Fifth Avenue Presbyterian Church (“Presbyterian” or “the Church”) and ten homeless persons.
