Appeal by the plaintiff, Mary L. Crawford, from a judgment of the Supreme Court in favor of the defendant, entered in the office of the clerk of the county of Hew York on the 4th day of April, 1901, upon the verdict of a jury, and also from an order entered in said clerk’s office on the 3d day of April, 1901, denying the plaintiff’s motion for a new trial made upon the minutes.

Ingraham, J.:

The plaintiff slipped and fell upon the sidewalk on the north side ■of One Hundred and Fourth street, west of Columbus avenue, and was injured, and this action is to recover from the defendant the damages thereby sustained. The complaint alleges that on or about the 1st day of December, 1898, and for upwards of a week prior thereto, as well as thereafter, the defendant carelessly and negligently permitted and allowed the sidewalk or pavement in front of the vacant lots between Nos. 109 and 119, on the north side of said One Hundred and Fourth street, and at and about 160 feet…
