LOKEN, Chief Judge.

After exhausting his administrative remedies, FAA aviation safety inspector Donald I. McKay commenced this action against the U.S. Department of Transportation, alleging that the FAA’s Flight Standards District Office (FSDO) in Minneapolis violated the Age Discrimination in Employment Act (ADEA) when it passed him over for promotion on account of his age. See 29 U.S.C. § 633a, which prohibits age discrimination against federal employees.
