DONOHOE, Chief Judge.

This action is an appeal from a decision by the Appeals Council of the Federal Security Agency, acting for and on behalf of the Federal Security Administrator, under the provisions of Section 205(g) of the Social Security Act, as amended. 42 U.S.C.A. § 405(g).

On July 7,1952, a hearing on the claim which is the subject of this action was held in Omaha, Nebraska, before Myers D. Campbell, a duly appointed, qualified and acting Referee of the Federal Security Agency. On December 3, 1952, said Referee entered a decision denying the plaintiff’s claim. On December 13, 1952,…
