This appe.al presents.for determination the question as to whether the action of the Board of Commissioners of the City of Winchester in their re-employment of the appellant, John Clay Park, as Captain of the Police, was an appointment or a reinstatement.

John Clay Park was appointed, policeman for the City of Winchester in 1926. He continued in this position until February 4, 1939, at which time he was made Captain of Police, which position he held until January 1942.
