Error to Wayne; Rohnert, J. Assumpsit by Fritz Krapp against the Metropolitan Life-Insurance Company on a policy of insurance. There was judgment for plaintiff on a verdict directed by the court, and defendant brings error.

The defendant, the Metropolitan Life-Insurance Company, is a New York insurance com*370pany, having offices and doing business in the State of Michigan. On March 11,1902, it issued a policy of insurance on the life of Minnie Krapp, who was the wife of the plaintiff. The policy was in the sum of $500. Minnie Krapp died on July 6, 1903. The defendant refused to pay the policy on the ground that answers made by the insured to certain questions in the application on which the policy was issued, were not true.
