This is an appeal from a judgment for the defendant in an action to set aside certain decrees in favor of the defendant, and for other relief.

The facts material to a determination of the rights of the par*372ties, are as follows: On the 6th day of November, 1872, the plaintiff, Yantilburgh, and wife executed to the defendant, Black, a mortgage upon a certain tract of land known as the "Warm Springs Banch, comprising one hundred and sixty acres, upon which there was situate a water right and a flouring mill then in process of construction, and upon a certain other tract of land…
