GRISSOM, Chief Justice.

This is a suit by Joe Nonken against Bexar County to remove cloud from his title to a 106.42 acre tract of land. The real purpose of the suit was to close a road claimed by the County across Non-ken’s land, which road, it was alleged, covered 1.6 acres. Nonken alleged that he bought the land in 1942; that since then it had been surrounded by a substantial fence and that Bexar County claimed an easement across his land by prescription.
