Appeal from Sioux District Court. Tuts is an action in equity which involves the title to three hundred and twenty acres of land in Sioux county. There was a decree in the district court for the plaintiff, and the defendant appeals.

The land in controversy was sold by the treasurer of the county on the 2d day of October, 1871, to Henry Elkenbnrg, for the delinquent taxes of 1870.
