June 25, 1929, plaintiffs, who had been stockholders in the A. E. Walker Candy Corporation, brought suit against defendants by declaration containing three counts, one of which charged defendants obtained plaintiffs’ property and money by fraud and deceit; another charged fraud and deceit, plaintiffs’ resulting injury, and waived the tort and counted in assumpsit; to which was added the common counts in assumpsit.
