KELLUM, Judge.

This Court’s opinion of March 26, 2010, is hereby withdrawn and the following opinion is substituted therefor.

The appellant, Allen Hinkle, was convicted of one count of murder, a violation of § 13A-6-2, Ala.Code 1975, and one count of attempted murder, a violation of §§ 13A-4-2 and 13A-6-2, AIa.Code 1975. The trial court sentenced Hinkle to life imprisonment for the murder conviction and to 99 years’ imprisonment for the attempted-murder conviction. Hinkle was also ordered to pay restitution and to pay an assessment to the Crime Victims Compensation…
