These two appeals coining upon the same record, and involving substantially the same questions, will be disposed of in one opinion.

The original snit was brought by Fletcher against Wireman to enforce the specific performance ,of a coni tract concerning real estate which Fletcher alleged- he had purchased by executory contract from Wiremian. Pending this suit Skidmore, to whom Wireman conveyed the land that Fletcher claimed had been sold to him, filed an intervening petition asserting his rights, and upon final hearing the…
