On July 28, 2000, Eleanor Brooks, district attorney for Montgomery County, acting on behalf of the State of Alabama, Miriam Shehane, and Wanda G. Jones, filed an action against the Alabama Board of Pardons and Paroles (hereinafter the "Board"). In that action, Brooks sought a declaratory judgment and an injunction to prevent the Board from acting on its decision to parole Kenneth Thornton and Michael Thornton (hereinafter together referred to as "the Thorntons").
