This is the third appeal of this ease. The opinions on the former appeals are reported in 237 Ky. 541, 35 S. W. (2d) 894, and 264 Ky. 823, 95 S. W. (2d) 802. We shall confine onr statement to a very brief summary of the issues and facts and refer to the former opinions for a more comprehensive statement.
