This is a suit seeking reimbursement from a mortgagor for real estate taxes paid by a mortgagee after deed of trust foreclosure. The appellant-mortgagees, John A. Jackson and William H. Bowie, sued the appellee-mortgagor parties, Stonebriar Partnership and Marborough Texas Properties, Inc. (“Stonebriar”) for reimbursement. The parties filed cross-motions for summary judgment.
