Guadalupe Javier Heredia-Fernandez (“Heredia”) appeals from his misdemeanor conviction for entering the United States illegally, in violation of 8 U.S.C. §. 1325, and felony conviction for entering "the United States illegally after having been deported, in violation of 8 U.S.C. § 1326.
