In Error to the Circuit Court of the United States for the Eastern District of Tennessee. This was an action by Mary M. Boberson against the Western & Atlantic Bailroad Company to recover damages for the death of her husband.

LURTON, Circuit Judge.

The defendant in error is the widow of Jesse (I Boberson, who was struck and killed by a passenger train of tbe Western & Atlantic Bailroad Company. The deceased was at the time attempting to cross I he track in a top buggy at a public road crossing in Hamilton county, Tenn., near OWeamauga station.
