The defendant was tried for murder, convicted of manslaughter, and from a sentence of from 10 to 12 years in the penitentiary presents this appeal.

The only bill of exception found in the record relates to the overruling of a motion for a new trial and a motion in arrest of judgment.

The motion for a new trial is based on the groond of newly discovered evidence which it is alleged will be produced in the persons of Edward Horace and E. C. Holmes.
