Plaintiff brought an action to recover damages for personal injuries alleged to have been caused through and by the negligence of the defendant. At the time of the commencement of this action the plaintiff procured the issuance of a writ of attachment on the ground that the action ivas one to recover damages and that the defendant was not a resident of the state' of North Dakota.
