WATKINS, District Judge.

Petitioner, a Maryland State prisoner, seeks in this court the issuance of a writ of habeas corpus. On November 21,1961 he was charged in a six-count indictment with violation of the narcotics laws of Maryland. The first three counts charged him respectively with possession of a narcotic drug, having a narcotic drug under his control, and possession of narcotic paraphernalia and the last three counts charged him with these violations as a second offender, based upon a previous 1957 conviction under the narcotics laws of Maryland.
