In this appeal, the defendant, Buddy Rich, challenges the sentencing procedure employed and the sentences imposed after he was found guilty by a jury of two separate offenses involving the delivery of a controlled substance and a third offense, the delivery of a substance represented to be a controlled substance. At the sentencing hearing, the defendant was given an opportunity to elect between being sentenced pursuant to the law in effect prior to February 1, 1978, or being sentenced under the present sentencing laws.
