Mr. Justice North has stated the facts. He holds the admission by the trial court, against defendant’s objection, of evidence of another fake hold up of defendant, when he was riding in the same or a similar vehicle, on the streets of the same city, such hold up being in the nighttime, and staged for the ostensible purpose of robbery, and used, as claimed by the people, as a cloak for the consummation of another felony, and a shield against detection, constituted reversible error. I think such proof was admissible to show concurrence of common features in the two similarly staged hold ups…
