Proceeding pursuant to CPLR article 78 (transferred to this Court by order of the Supreme Court, entered in Albany County) to review a determination of respondent which found petitioner guilty of violating certain prison disciplinary rules.

Petitioner was charged in three misbehavior reports with numerous disciplinary rule violations after he refused a correction officer’s directive to turn down his radio or use headphones and, as a result, asked to speak to a correction sergeant whom he attempted to strike and was found with a broken piece of razor blade hidden inside his boot.
