This suit was instituted by George W. Ferguson against Mary Ann Porter, executrix of the last will and testament of Joseph Y. Porter, deceased, in the Circuit Court of Monroe County, to recover damages for on alleged breach of duty by the said Joseph Y. Porter, as the, bailee and factor of the plaintiff in this suit. The declaration contains two counts. The first charges, that in the month of January, in the year 1846, the plaintiff and the said Joseph Y. Porter, (then living but since deceased) entered into an agreement, together, whereby the said plaintiff was to manufacture…
