In the year 1836, the plaintiffs brought suit upon a note for' $20,-000, against Elias Bass, as endoi-ser, who died pending, the action ; his-widow was made party in his stead, and, in 1842, a judgment was rendered in-favor of the plaintiffs. In 1843', an appeal was taken by the defendant. After the case came to the Supreme Court it was set for argument, heard, and taken-under advisement of ou-r predecessors; but not having been decided, it was again setfor argument before this court.
