RAM-SET, Judge.—The

appellant was charged by information in the County Court of Nacogdoches County with the offense of unlawfully carrying on and about .his person a pistol. On trial he was convicted and his punishment assessed at a fine of one hundred and twenty-five dollars and thirty days ■ confinement in the county jail.

The evidence was undisputed that appellant had on bis person a pistol. His defense was, in substance, that the pistol had been given to him by one Bishop to carry to his, appellant’s, home, and that when discovered with the pistol upon his person he was in the act of…
