Proceeding pursuant to CPLR article 78 (transferred to this court by order of the Supreme Court, entered in Albany County) to review a determination of respondents which denied petitioner release on parole.

Petitioner struck and killed a teenage pedestrian while driving under the influence of alcohol. He was convicted for criminally negligent homicide and leaving the scene of an accident without reporting.
