KERN, Associate Judge:
The District Unemployment Compensation Board (Board) appeals from the trial court’s order which preliminarily enjoined the Board from increasing, as of June 30, 1975, the rate of contribution for unemployment compensation by the appellee-em-ployers during each of the third and fourth quarters of calendar year 1975. The trial court ruled that under the terms of D.C. Code 1973, § 46-303(c)(4)(B), the Board could not require appellees to make an immediate increase in their contribution rate but rather they might defer such increase until the beginning of the calendar year…
