HENLEY, Senior Circuit Judge.

Following a jury trial Douglas K. Condon was convicted for knowingly possessing a controlled substance. 21 U.S.C. § 844(a). The district court 1 sentenced Condon to the maximum term of imprisonment allowable under § 844(a), one year. The district court also imposed a fine of $20,000.00. This fine exceeds the amount specified in § 844(a), but was imposed pursuant to the alternative fine schedule. 18 U.S.C. § 3623(a)(5), repealed effective Nov. 1, 1986 by Sentencing Reform Act of 1984, Title II, ch.
