BEAUCHAMP, Judge.

The appeal is from a conviction for the possession of marihuana, with a sentence of six years in the penitentiary.

Appellant was engaged in some kind of business in a hall which, at the time of the charge, seems to have been barren of visible merchandise and was occupied by several customers who were dancing to the music of a nickelodeon. The officers *9entered the place with a search warrant and were looking for whisky.
