On July 2, 1986, the Cook County State’s Attorney filed a complaint requesting forfeiture of a 1946 Buick automobile bearing vehicle identification number 34423520. The complaint was filed pursuant to section 505(aX3) of the Illinois Controlled Substances Act (Act). (See Ill. Rev. Stat. 1985, ch. 56V2, par. 1505(aX3).) Section 505(aX3) provides that a vehicle is subject to forfeiture if it is “used *** in any manner to facilitate any violation of this Act.” The circuit court denied the relief requested and ordered the vehicle released to the claimant, Samuel Smith.
