The defendant was indicted for a violation of the provisions of the Act of May 13, 1925, P. L. 644 (10 PS 141 et seq.) which relates to and regulates “the solicitation of moneys and property for charitable, religious, benevolent, humane and patriotic purposes.” The case came to trial before a judge without a jury pursuant to the Act of June 11, 1935, P. L. 319 (19 PS 786) and at the close of the Commonwealth’s ease the defendant demurred to the evidence and the Commonwealth concurred in the demurrer.
