MEMORANDUM AND DECISION

EDWARD D. HAYES, Bankruptcy Judge.

This case was remanded to this Court from the United States District Court, Judge John T. Curtin, to determine whether the documents and circumstances surrounding a loan from the Caccamises to Mr. Baker, the debtor, are sufficient to make the Caccamises secured creditors.

The trustee’s initial adversary proceeding sought to avoid the debtor’s pre-petition fraudulent conveyances of a yacht and interest in real property, void the debtor’s mother and father-in law’s (Caccamises) lien against the yacht, recover insurance proceeds which…
