KNUDSON, Justice.

On October 30, 1959, appellant went to the home of his divorced wife, Betty Clokey, at three different times, the first time being about 3:00 o’clock P.M. Appellant stated that his reason for going to said home at that time was to check with his son regarding a hit and run charge which had been filed against appellant. Upon arriving at Mrs. Clokey’s home he found her preparing to move to California, and observed that she was being assisted by her aunt, Florence Schleuse, and husband, Carl Schleuse.
