When this cause was called for trial, the appellant filed the following motion for a continuance :
“State of Oklahoma v. Dave Bryan. Motion for Continuance. Comes now the defendant, and moves the court to continue this cause of action for the reason that he cannot safely go to trial by reason of the absence of material evidenoe, and in support thereof attaches the following affidavit.
