HAMITER, Justice.

The defendant, Calvin Wilson Carter, was tried under'a bill of information charging the offense of carnal knowledge of a juvenile, she being thirteen years of age and he being above the age of eighteen years. During the course of the proceedings, over defendant’s objection, the court instructed the jury that if it found that defendant did not commit carnal knowledge of the prosecutrix it could find, if warranted by the evidence, that he attempted to commit that crime.
