J. W. Eckman, the defendant in error, brought his action against the Mexican Central Railway Company, Limited, the plaintiff in error, to recover damages on account of injuries received by him while operating a work train in a tunnel on the railway company’s road in the republic of Mexico. He was working on the San Luis Potosi Branch of the company’s road, on a division in the Rascón Mountains between Cardenas and Tampico.
