This was a prosecution for bastardy, and was commenced by affidavit and warrant before a justice of the peace before the child was delivered, during the pregnancy of prosecutrix, and defendant was then bound over to the circuit court. Between the time of such binding over and the trial in the circuit court the child was born. The complaint filed by the solicitor in the circuit court, after alleging that the prosecutrix was an unmarried Avoman, and that defendant was the father of her bastard child, and that she had been delivered of such child, alleged that the delivery Avas before the…
