MEMORANDUM OPINION

MICHAEL, District Judge.

This diversity action comes before the court on defendants’ summary judgment motion pursuant to Fed.R.Civ.P. 56. The matter has been fully briefed and argued to the court and is now ripe for disposition.

In this action, plaintiff, Service Steel Erectors Company (“Service Steel”), claims damages of $245,270 for alleged breaches of a construction subcontract by SCE, Inc. (“SCE”).
