The parties here are in the same positions which they occupied in the trial court, and will be referred to as the plaintiff and the defendant.

The plaintiff sued the defendant as ‘“the trustee of the employees’ benefit fund of the Summerville Manufacturing Company,” for damages from alleged injuries received in drinking impure and adulterated tomato juice, sold and served to the plaintiff by the defendant as such trustee in the operation of a re-, freshment stand within the manufacturing plant of the company.
