This was an action by the appellant for damages for personal injuries sustained by him by reason of being struck by parts of an automobile which was in collision with an engine of the appellee, the appellant at the time being a traveler on a public street of the City of Gary, Indiana.

The issues were formed by the complaint of the appellant, to which the appellee filed an answer in general denial. The cause was submitted to a jury and at the close of the appellant’s evidence the trial court instructed the jury to return a verdict for the appellee, which was accordingly done. The judgment…
