Defendant Luis Pelegrin, charged with violating Vehicle and Traffic Law § 1192 (1), (2) and (3), operating a motor vehicle while under the influence of alcohol or drugs, moves pursuant to Criminal Procedure Law § 170.30 (1) (f)1 to dismiss the charges against him on the grounds that they are based on violations of the Equal Protection and Due Process Clauses of the United States Constitution and of similar provisions in the New York State Constitution.
