Defendants in error, who were plaintiffs in the Circuit Court, recovered judgment against plaintiff in error for the sum of 85,500 on May 11th, 1891. A writ of error issued on January 27th, 1892, returnable to the present term of this court, and was duly served by lodging it in the clerk’s office of the Circuit Court on the 29th of the same month, and on the same day that clerk endorsed on the writ as his return thereto, an adoption of the transcript of the record then on file with our clerk, and the writ was returned to this court where it has been on file since the first day of…
