This is an action by Dexter Galbreath, plaintiff and appellant, for the conversion of 76 head of horses allegedly owned by the plaintiff and seized and sold at a sheriff’s sale by the defendant sheriff.

The case is before this court for the second time. The first trial resulted in a verdict for the plaintiff. On appeal the cause was reversed and remanded for a new trial. Galbreath v. Armstrong, Mont., 167 Pac. (2d) 337.

At the second trial the plaintiff had judgment for $1,960, which was subsequently modified to $1,775 by order of the trial court. The modification was accepted by the plaintiff.…
