The accusation in this case alleged that the accused did “maliciously maim and kill” two cows and a small steer. The accusation does not allege in what manner they were killed, but the record shows that the State endeavored to prove that they were shot on a certain Sunday afternoon. *592While the steer was found dead in the field of the accused, and one of the cows near this field, there is no evidence that either of these had been shot, but it was shown that they had been in a field where peas, corn, and groundpeas were growing.
