MURRAY, Justice.

This -is an appeal from a judgment of the special ninth district court of Montgomery county, entered on an instructed verdict in favor of the appellee, the defendant in the trial court.

The appellant brought suit against appel-lee, alleging that after he had located his home near the Conroe pil field, about five miles east of the city of Conroe, the appel-lee located its plant for the manufacture of carbon black near his home and soon thereafter, and continuously up to the date of the filing of this suit, appellee turned loose vast quantities of smoke, soot, carbon and vile…
