Blandfokd, Justice..Blackman was indicted and found guilty of murder for killiiigof S. J. Tondee, on the 5th of September, 1885. by the superior court of Schley county, at the September term, 1885. of said court. On Wednesday, the court having convened on the fourth Monday of said month, and the grand jury having returned the bill of indictment on Tuesday before, the accused being unable to employ counsel, and at that time confined in the common jail of Sumter county, the court announced that he would take up the case on Friday thereafter, and assigned as counsel for the *289prisoner, B.
